Artist Performance Agreement

Standard Engagement Contract

PERFORMANCE AGREEMENT

This Agreement is made as of the day of , 2028.

1. ENGAGEMENT AND PERFORMANCE

1.1 The Purchaser hereby engages the Artist, and the Artist hereby accepts such engagement, to perform at the venue(s) and on the date(s) as set forth in Schedule "A" attached hereto and incorporated by reference.

1.2 The Artist shall perform as a [HEADLINER / SUPPORT] act for the performances identified in Schedule "A".

1.3 The Artist agrees to perform a minimum of ______ minutes and a maximum of ______ minutes per performance, unless otherwise agreed in writing.

1.4 The Artist shall provide a complete stage plot, input list, and technical rider no later than thirty (30) days prior to the first performance date.

2. COMPENSATION

2.1 In consideration of the services rendered by the Artist, the Purchaser shall pay the Artist the compensation set forth in Schedule "B" attached hereto and incorporated by reference.

2.2 Payment shall be made as follows:

  1. A deposit of ______% of the total compensation shall be paid upon execution of this Agreement.
  2. The balance shall be paid [on the day of performance / within 30 days of performance].

2.3 All payments shall be made by [wire transfer / check / other] to the account designated by the Artist.

2.4 The Artist shall be solely responsible for all taxes, including income tax, applicable to compensation received under this Agreement.

3. TECHNICAL REQUIREMENTS

3.1 The Purchaser shall provide the technical equipment and personnel as specified in the Technical Rider attached as Schedule "C" hereto.

3.2 The Artist shall provide all musical instruments, amplifiers, and personal equipment required for the performance, unless otherwise specified in the Technical Rider.

3.3 Soundcheck time shall be scheduled by mutual agreement, with a minimum of ______ minutes provided to the Artist prior to doors opening.

3.4 The Purchaser reserves the right to approve all technical requirements and may negotiate modifications to the Technical Rider based on venue limitations.

4. HOSPITALITY AND ACCOMMODATIONS

4.1 The Purchaser shall provide the hospitality requirements as specified in Schedule "D" attached hereto.

4.2 For performances requiring overnight stay, the Purchaser shall provide:

  1. ______ hotel rooms for Artist and entourage;
  2. Rooms shall be of [4-star / 5-star] quality or equivalent;
  3. Rooms shall be available from 3:00 PM on the day of performance until 12:00 PM the following day.

5. MERCHANDISE

5.1 The Artist shall have the right to sell merchandise at the venue during the performance, subject to the venue's policies.

5.2 The venue shall receive a commission of ______% of gross merchandise sales, if applicable.

5.3 The Artist shall provide all merchandise for sale and shall be responsible for all sales personnel, unless otherwise agreed.

5.4 A dedicated merchandise area of not less than ______ square feet shall be provided in a high-traffic location.

6. RECORDING AND BROADCAST RIGHTS

6.1 The Artist retains all rights to any recordings made of the performance, unless otherwise agreed in writing.

6.2 The Purchaser shall not record, broadcast, or stream the performance without the prior written consent of the Artist.

6.3 The Artist grants the Purchaser the right to use the Artist's name, likeness, and biographical material for promotional purposes related to this engagement only.

6.4 Any footage recorded by the Purchaser for promotional purposes shall not exceed ______ minutes and shall be approved by the Artist before public release.

7. CANCELLATION

7.1 If the Artist is unable to perform due to illness or other reasonable cause, the Artist shall give the Purchaser written notice as soon as practicable. The deposit shall be returned and no further compensation shall be due.

7.2 If the Purchaser cancels this engagement:

  1. More than sixty (60) days before the performance, the Artist shall retain ______% of the deposit;
  2. Between thirty (30) and sixty (60) days before the performance, the Artist shall retain ______% of the total compensation;
  3. Less than thirty (30) days before the performance, the Artist shall receive full compensation.

7.3 In the event of cancellation due to Force Majeure (including but not limited to natural disaster, pandemic, government action, or act of God), neither party shall be liable for damages, and the parties shall work in good faith to reschedule the performance.

8. INSURANCE AND LIABILITY

8.1 The Artist shall maintain comprehensive general liability insurance with minimum coverage of $________ per occurrence.

8.2 The Purchaser shall maintain property insurance and liability insurance for the venue and event.

8.3 Each party shall be responsible for its own negligence and shall indemnify the other against claims arising from its own wrongful acts or omissions.

9. GENERAL PROVISIONS

9.1 This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements relating to this subject matter.

9.2 This Agreement may be amended only by written instrument signed by both parties.

9.3 This Agreement shall be governed by the laws of the Province of British Columbia and the laws of Canada applicable therein.

9.4 Any dispute arising under this Agreement shall be resolved through binding arbitration in Vancouver, British Columbia.

9.5 If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.

9.6 Neither party may assign this Agreement without the prior written consent of the other party.

10. NOTICES

10.1 All notices under this Agreement shall be in writing and delivered by email with read receipt confirmation, courier, or registered mail to the addresses first set out above.

10.2 Notices shall be deemed received upon delivery if by email or courier, and five (5) business days after mailing if by registered mail.

IN WITNESS WHEREOF, the parties have executed this Agreement as of the date first written above.
